I read this morning that Utube is suingYouTube for damages because ever since YouTube became popular, Utube was forced to spend a lot of money upgrading their servers to deal with the traffic. A slashdot commenter wondered if they were also planning to sue EweTube too?

But seriously, Utube is thinking about this all the wrong way. They should be using the excess traffic generated from people looking YouTube to grow their business! (I guess they are in a way: If they collect damages... litigation is one way to raise revenue...)
